Public holidays are meant to be a time of rest, celebration, and connection, but in many industries, business doesn’t stop. Whether it’s hospitality, retail, emergency services, or essential operations, employers often need staff to work on days most people spend at home. South African labour law allows this, but it comes with clear rules and responsibilities that every employer and employee should understand.
The Basic Conditions of Employment Act 75 of 1997 (BCEA) sets out standards for how public holidays must be treated.
- Public holidays are paid days off for employees who would ordinarily work on that day.
- If an employee works on a public holiday, they must be paid at least double their normal wage.
- Alternatively, the employer and employee may agree to paid time off instead of double pay.
The BCEA further states that an employer may not require an employee to work on a public holiday unless:
- The employee normally works on that day, and
- Working on public holidays is expressly included in the employment contract.
This second requirement is often overlooked, yet it is crucial. If an employer expects employees to work on public holidays—whether occasionally or regularly, this expectation must be clearly stated in the employment contract.
To stay compliant and maintain positive workplace relations, employers should:
- Include clear public-holiday clauses in all employment contracts.
- Communicate schedules early, especially around major holidays.
- Ensure payroll accuracy for double-pay calculations.
- Apply policies consistently across all employees.
- Avoid last-minute changes that could be seen as unreasonable or coercive.
Public-holiday work is a reality in many sectors, but it doesn’t have to be a source of conflict. With clear contracts, fair compensation, and consistent communication, employers can meet operational needs while respecting employee rights.
